Mandatory Reporting of Child Abuse/Neglect

Policy:

California State University Chancellor's Executive Order 1083 (Revised March  2025), the Mandatory Reporting of Child Abuse and Neglect, provides direction on implementing the California Child Abuse and Neglect Reporting Act (“CANRA”) (Penal Code §§ 11164-11174.3), which is intended to protect children from abuse and neglect. CANRA identifies certain groups of employees as 'Mandated Reporters' of child abuse and also imposes various obligations on and extends certain protections to those Mandated Reporters as well as their employers. As a covered employer, the California State University (CSU) is required to comply with the Act. Relevant excerpts of the Act are provided as Attachments to the Executive Order, along with necessary forms. 

Executive Order 1083:

  • Identifies the categories of employees within the CSU that are Mandated Reporters;
  • Explains the difference between two types of Mandated Reporters;
  • Provides information to Mandated Reporters regarding their reporting requirements and the procedures they must follow;
  • Provides information to Mandated Reporters regarding the legal immunity extended with respect to their reporting;
  • Provides forms and training resources for Mandated Reporters (training is available for all employees and volunteers); and
  • Identifies information that is required to be included on job postings/position announcements and job descriptions.
  • General Reporters - those who are legally required to report child abuse or neglect no matter where it occurs.
  • Limited Reporters - those who are legally required to report child abuse or neglect only if it occurs on CSU premises or at an official activity of, or program conducted by, the CSU.

Mandated Reporter Categories:

The two categories of Mandated Reporters are:

All CSUSB Management Personnel Plan (MPP) employees and volunteers are considered Limited Reporters, unless they are in positions that require the General Reporter designation. Authorized CSUSB employees whose duties involve regular contact with children or who supervise such employees are considered as general reporters.

All individuals working with minors defined by CSUSB’s Youth Protection policy must complete Mandated Reporter training. Departments training students who work with minors can offer Mandated Training, but it is not required. Volunteers, and CSU employees hired after 1/1/1985 identified as Mandated Reporters, and those working with minors will be required to sign a statement that acknowledges their reporting obligations either as a General Reporter or Limited Reporter.

Roles and Responsibilities

The following units bear distinct responsibilities and will work to execute the Mandated Reporting Program:

  • Human Resources Units:
    • Talent Aquisition: Determine Mandated Reporting responsibilities by identifying MPPs, and other employees for assignment as mandatory reporters, and informing individuals of their CANRA obligation and mandatory reporter status during the new hiring process;
    • Administrative Services: Determine Mandated Reporting responsibilities by identifying relevant volunteers for assignment as mandatory reporters, and informing individuals of their CANRA obligation and mandatory reporter status;
    • Classification and Compensation Services: Determine Mandated Reporting responsibilities during review and evaluation activities and ensuring individual documents inform employees of their CANRA obligation and mandatory reporter status during the position review process;
    • Staff Development Center: Assign Mandatory Training to CSUSB employees and affiliates via CSU Learn when advised by HR Units and Risk Management, and run compliance reports; for Risk Management
    • Review adherence to the policy when reports of abuse and neglect are received.
  • Faculty Affairs and Development:
    • Collaborate with Colleges and/or Departments to determine Mandated Reporting responsibilities by identifying faculty for assignment as mandatory reporters and informing faculty of their CANRA obligation and mandatory reporter status.
  • Risk Management:
    • Verify completion of the Mandated Reporter Training for employees in Youth Protection Programming
    • Monitor campus compliance of the Mandated Reporter policy
    • Ensure incident reports of abuse/neglects comply with the campus policy and are reported to the appropriate agencies;
    • Update the Mandated Reporter Policy as needed; and
    • Review adherence to the policy when reports of abuse and neglect are received.

Reporting Abuse and Neglect:

Mandated Reporters are legally required to report suspected child abuse or neglect as follows:

Apart from the obligations set forth in Executive Order 1083, California State University strongly encourages all members of the CSU community who are not designated under the Act, to report child abuse and neglect occurring on CSU premises or at an official activity of, or program conducted by, the CSU.

Note: In case of an emergency or if a crime is in progress, employees should always immediately call campus police or 911.

Auxiliary employees and other non-CSU employees are not covered under this Policy but are strongly encouraged to report suspected child abuse or neglect. The auxiliary is responsible for designating their employees and notifying them of their CANRA obligations as an auxiliary employee, assigning training and follow-up on completion.
