Policy:

The purpose of a parking policy is to establish the procedures, rules and guidelines for administering the parking program by Parking and Transportation Services and University Police at California State University San Bernardino.

In this policy, the term ‘permit’ shall be defined as an appropriate parking privilege obtained virtually or a valid/properly displayed physical decal from Parking and Transportation Services Department.

Procedures:

SECTION 1.00 --- AUTHORITY TO REGULATE PARKING AND DETERMINE FEES

  1. This policy, and campus ordinances are pursuant to California Vehicle Code Section 21113 and Title 5, Division 5, Subchapter 5 of the California Code of Regulations, which states parking fees shall be assessed to park vehicles upon CSU campuses. Compliance shall be demonstrated by proper display of a valid permit or other approved authorization (e.g. License Plate Recognition “LPR”).
  2. All applicable provisions of the California Vehicle Code (CVC) apply anywhere on university property. Parking regulations are enforced 24-hours a day, 7-days a week.
  3. Citations are issued pursuant to CVC 40202. The citation appeal process is conducted pursuant to CVC 40215 and 40230.

SECTION 1.01 --- PARKING PERMITS ARE THE PROPERTY OF THE UNIVERSITY

Parking permits are the property of CSUSB and may be revoked or recalled by the campus at any time. Parking permits are non-transferablemay not be resold, and can only be used by the individual to whom the permit was assigned.

SECTION 1.02 --- PARKING PERMIT REQUIRED

All vehicles on campus must have a valid parking permit, except in timed spaces (e.g., 30- Minute Parking), where permits are not required within the specified time limits. Parking permits are required 24 hours a day, 7 days a week.

SECTION 1.03 --- OBTAINING A PARKING PERMIT

  1. EMPLOYEES: Full-time employees with appointments over 12 months may opt to purchase an annual permit on a pretax basis via payroll deduction. Employees who do not qualify may purchase a semester permit.
  2. STUDENTS: Students parking on campus may purchase a semester, academic year or daily permit.
  3. VISITORS: Daily permits can be purchased from the designated parking app and parking dispensers. For more information, please visit the Parking and Transportation website.
  4. CAMPUS PARTNERS: Departments can request parking permits for visitors and campus partners by completing the Invited Guest Request Form available on the Parking Services webpage and are responsible for any associated fees.

SECTION 1.04 --- FRAUDULENT/LOST/STOLEN PARKING PERMITS

Vehicles with revoked, forged, or altered permits will be cited. Displaying a lost or stolen permit is subject to citation. Multiple vehicles associated to a single virtual permit found to be concurrently parked on campus will be subject to a citation. Fraudulent use of permits may lead to campus disciplinary action or penalties set forth under the California Penal Code. Lost parking permits will not be replaced, and additional permits must be purchased at full face value at owners expense. Stolen permits off-campus must be reported to the local Police Department and are subject to a replacement fee with a copy of the police report. Permits stolen on CSUSB property will be replaced at no charge with a copy of the CSUSB University Police report. Permits lost due to vehicle collision are not eligible for replacement. Permits damaged (discoloration, non-adhesiveness, ripped, torn, etc.) will be replaced at no charge after damaged permit is returned.

SECTION 1.05 --- TYPES OF PERMITS

  1. GENERAL PERMIT: Valid in general, unmarked parking spaces.
  2. RESIDENT PERMIT: Available only to campus housing students; valid in resident and general spaces.
  3. FACULTY AND STAFF PERMIT: Available only to qualifying faculty and staff; valid in Faculty/Staff and general, unmarked spaces.
  4. MOTORCYCLE PERMIT: Available only to qualifying two-wheeled motor vehicles, valid in motorcycle marked areas only.
  5. RETIREE PERMIT: Retirees with more than seven years of service to the campus, and with no active campus position, will be allowed to register one vehicle registered to their name in California, in our sticker-less parking system portal. Retired faculty and staff will be required to renew their permit annually by contacting Parking and Transportation Services. Retiree permits will be valid in general unmarked spaces and may ONLY be used by the retired employee. Fraudulent use may result in citation, confiscation, deactivation of permit and permanent exclusion from the program.
  1. REHIRED ANNUITANT/FERP PERMIT– Retired employees returning to serve in a temporary appointment are eligible to purchase a SEMESTER or ANNUAL FACULTY/STAFF parking permit. FERP participants will pay the current CFA Unit 3 rate for a parking permit.
  2. INVITED GUESTS & SERVICE/VENDOR PERMITS: Departments may request parking permits for visitors and partners online via the Invited Guest Permit Request Form. Hosting departments are responsible for parking fees associated with the request.
  3. EVENT PARKING PERMITS: The Director of Parking or designee will determine the parking accommodation for each event, based upon factors such as location, attendance, and nature of the event. Costs will be based on the daily rate and any additional services required (i.e. traffic control, signage, etc.).

SECTION 1.06 --- COMPLIMENTARY PARKING

The following individuals/events may qualify for complimentary parking. Requests will be reviewed and approved by Parking and Transportation Services.

  1. Prospective students with Outreach & Student Recruitment appointments
  2. Candidates hosted by Human Resources Department or Academic Personnel
  3. Employment recruiters hosted by the Student Career Center
  4. Campus advisory groups and major donors as officially sanctioned by the Division of University Advancement subject to review and approval by Parking and Transportation Services.
  5. Campus sponsored events that impact the whole campus community subject to the discretion of Parking and Transportation Services (e.g. Commencement)

SECTION 1.07 --- CSU CAMPUS/CHANCELLOR OFFICE PERMITS (Concurrent Employee)

CSUSB will honor other CSU campus Faculty/Staff permits based on respective collective bargaining agreements (CBA’s) when on campus for official university business. Chancellor’s Office permits will be honored if employees are on campus for official university business.

CHAPTER 2 – PARKING RULES AND REGULATIONS SECTION 2.00 --- GENERAL INFORMATION

  1. The provisions of these Rules and Regulations are adopted for the purpose of promoting safe and orderly parking and movement of vehicles within the boundaries of CSUSB or other properties owned, operated or controlled by CSUSB.
  2. All persons who operate a motor vehicle on CSUSB property are responsible for complying with the Rules and are subject to penalties for violations of the Rules’ provisions. The purchase of a permit does not guarantee a parking space and the inability to find parking within a designated parking area does not justify violating the Rules.
  1. Parking at the University is solely at the vehicle’s owner or drivers’ risk. The State of California assumes no liability or responsibility for any damage or loss caused by fire, theft, accident or any other cause to any vehicle and its contents parked on university property.
  2. Parking and Transportation Services has sole authority at CSUSB to issue parking permits or to collect a fee from vehicles parking at the university.
  3. Vehicles parked on University Property without authorization may be cited and towed at the owner's expense.
  4. Vehicle repairs or washing are only allowed in areas designated by Facilities Management.

SECTION 2.01—TYPES OF PARKING SPACES

  1. ACCESSIBLE SPACES: Blue accessible parking spaces on campus require both a valid CSUSB permit and a DMV-issued placard or license plate.
  2. CARPOOL/VANPOOL SPACES: Vehicles parked must secure both a valid CSUSB parking permit and a valid carpool permit from the Parking and Transportation Services department.
  3. ELECTRICAL VEHICLE CHARGING SPACES: Vehicles must have a valid CSUSB permit and be ACTIVELY charging to use the designated space. The maximum charging time is 4 hours; exceeding this limit may result in a citation.
  4. FACULTY/STAFF SPACES: Vehicles parked must secure a valid Faculty/ Staff parking permit.
  5. MUSEUM VISITOR SPACES: Vehicles parked must be visitors to the Robert and Frances Fullerton Museum of Art and adhere to the regulations posted on the Museum Visitor Space signs.
  6. MOTORCYCLE: Two-wheel motor vehicles must secure a valid parking permit and park in motorcycle marked areas only, except for time-limited spaces.
  7. RESERVED SPACES: Vehicles parked in reserved spaces must secure a valid parking permit for the specific reserved space (e.g. Outstanding Faculty Advisor, Employee of the Year, etc.).
  8. RESIDENT SPACES: Vehicles parked must secure a valid Resident parking permit which is only available to on-campus housing residents.
  9. SERVICE VEHICLE SPACES: Vehicles parked must secure a valid service vehicle permit. University Police, Parking, and Facilities Services owned vehicles may park in service vehicle spaces without a service permit.
  10. TIME LIMITED SPACES: Vehicles in timed spaces must adhere to posted time limits. Each consecutive instance of overtime parking constitutes a separate violation. “Employees Only” or “Service Vendors Only” spaces require the corresponding permit.
  11. UNMARKED, GENERAL COMMUTER SPACES: Vehicles parked in unmarked spaces must secure a valid parking permit.
  12. OVERSIZED VEHICLES: Vehicles that are wider than 9 feet or longer than 18 feet. Oversized vehicles must park in designated oversize parking lot/zone. Parking of oversized vehicles in general stalls may result in a citation. For more information visit the parking website.

SECTION 2.02 --- RESTRICTED PARKING AREAS

  1. RESTRICTED PARKING -- CAMPUS CORE AREA -- ON STREET: Parking within the core campus streets or pathways is prohibited. The campus core area is closed to general traffic. Request for vehicular access will be evaluated by Parking Services.
  2. RESTRICTED PARKING --- CAMPUS CORE AREA --- OFF STREET: Parking in designated off street parking within the core of campus is prohibited. Request for vehicular access will be evaluated by Parking Services.
  3. RESTRICTED CAMPUS CORE AREA: Use of the core area as a short cut is prohibited and subject to citation.
  4. RESTRICTED PARKING --- CONSTRUCTION SITE: Only authorized contractors and their employees may park within the construction site fenced area with a vendor/service permit. Other construction vehicles must use general spaces with a valid permit.
  5. RESTRICTED PARKING --- NO STOPPING/NO PARKING SIGNS AND CURB MARKINGS:
    1. RED curbs/crosshatching denote fire lanes or emergency access. No stopping, parking, loading or unloading authorized.
    2. YELLOW curbs/crosshatching mark loading or unloading zones of materials. Loading/unloading shall not exceed the maximum time posted.
    3. WHITE curbs mark drop-off/pick-up zones with a 5-minute maximum stopping time.
    4. GREEN curbs/spaces authorize parking for the length of time on the posted sign.
    5. BLUE curbs/crosshatching indicate accessible parking or loading areas. Unauthorized vehicles parked there will be cited.
  6. RESTRICTED PARKING --- UNPAVED GROUNDS: All vehicles must park upon paved areas in marked parking spaces. No vehicle is allowed to park on the surf, landscaped, undeveloped or raw grounds. Exceptions may only be made by Parking & Transportation Services or UPD.

SECTION 2.03 --- OBSTRUCTING TRAFFIC

Vehicles may not be stopped or parked in any manner that may obstruct driving lanes. Vehicles obstructing the normal flow of traffic may be towed at the expense of the owner.

SECTION 2.04 --- PARKING SPACE USE STANDARDS

  1. Only one vehicle is permitted per marked space. Vehicles over the line will be cited.
  2. Oversized vehicles must secure additional parking accommodations from Parking Services.
  3. Head-in parking is required in all campus parking spaces, except on EV Charging spaces. A citation will be issued to vehicles backed into head in only spaces.

SECTION 2.05 --- LODGING IN A VEHICLE PROHIBITED

Persons may not reside within their vehicle overnight or use their vehicle, motor home, trailer, boat or house car for lodging purposes on CSUSB property. Vehicles found in violation will be ticketed and subject to tow away per CVC Section 22651 (n).

SECTION 2.06 --- ACCESSIBLE PARKING

  1. CSU employees and students must display both a valid CSUSB permit and a DMV disabled placard while parked in disabled spaces. Visitors (non-CSU affiliates) with a valid disabled placard may receive a courtesy day permit by verifying their visitor status, providing their Disabled Placard Registration Card, placard/plate, and government- issued ID.
  2. Persons who park in accessible spaces, while displaying a placard issued to another individual will receive a citation, and the disabled placard will be confiscated.
  3. CSU students with a disabled placard and a demonstrated financial need may apply for a waiver of campus parking fees.

SECTION 2.07--- REMOVAL OF VEHICLES

Under the California Vehicle Code, University Police or Parking Services officers are authorized to immobilize or impound vehicles for the following reasons:

  • CVC 22651 (i)             Failure to respond to 5 or more delinquent parking citations
  • CVC 22651 (o)            Vehicle registration expired in excess of 6 months
  • CVC 22651 (j)             No license plates or evidence of registration displayed
  • CVC 22669 (a) & (d)  Abandoned, inoperable or a vehicle under repair which is a hazard to public health, safety and welfare

SECTION 2.08 --- REMOVAL OF A VEHICULAR IMMOBILIZATION DEVICE

Removing, damaging, or interfering with a vehicular immobilization device will result in charges for damage and possible criminal penalties under California Penal and Vehicle Codes.

SECTION 2.09 --- ADDITIONAL REGULATIONS

  1. Employees awarded "OUTSTANDING FACULTY ADVISOR" and "EMPLOYEE OF THE YEAR" will receive a parking space of their choice from a designated list. Spaces are non- transferable and are only to be utilized by the awardee for a one-year period.
  2. Vehicles are not allowed to park in cart parking spaces. University operated carts must park in spaces designated for cart parking.
  3. Non-operational vehicles must be reported to the University Police or Parking Services. If it is considered a hazard the vehicle will be subject to towing per CVC 22651(b).

CHAPTER 3 – CITATIONS AND APPEALS SECTION 3.01---CITATIONS

  1. Violations of these Rules or the California Vehicle Code on CSU property may result in a citation under the California Vehicle Code, California Penal Code, or other statutes.
  2. Parking Rules and Regulations are enforced by University Police officers, community service specialists, and other personnel assigned by the Chief of Police.
  3. The Schedule of Parking Citations can be found at parking.csusb.edu.

SECTION 3.02 ---CITATION APPEALS

Under CVC 40215, requests for Administrative Review of citations must be made within 21 days of issuance or 14 days of a delinquency notice. The appeal form is available on the parking website. There are three appeal levels per CVC 40215.

  1. FIRST LEVEL: The Citation Review Committee/Officer will review the appeal. If the appeal is denied, the appellant has the option of requesting an Administrative Hearing.
  2. SECOND LEVEL: The appellant must post bail before requesting a second-level hearing but can request a penalty waiver if indigent under CVC 40215(b) and 40220(c)(1). The request must be made within 21 days of the initial review. The hearing is conducted via Zoom or mail by an independent adjudicator. If the appellant wins the bail will be refunded.
  3. THIRD LEVEL: If the appellant loses at the Administrative Hearing level, they can request a de novo hearing in municipal court: Fontana Superior Court for San Bernardino Campus citations, or Indio (Larson Justice Center) for Palm Desert Campus citations.

SECTION 3.03--- PAYMENTS

Citation payments can be made online or by mail. Late fees apply if not paid or appealed within 21 calendar days of issuance or 14 days from the mailing of the delinquency notice. Per ICSUAM Policy 4071, individuals with multiple citations or totals of $200 or more may enroll in a payment plan.

CHAPTER 4 --- ALTERNATIVE TRANSPORTATION

Parking and Transportation Services, in collaboration with the CSUSB community, is required to decrease drive-alone trips to campus. The South Coast Air Quality Management District (SCAQMD) established an Average Vehicle Ridership (AVR) goal for the campus. Annually, a survey will be conducted to track commuting patterns over five days, assessing progress toward this AVR goal. To meet this obligation, Parking Services provides several incentives to employees and students to encourage the use of alternative transportation modes (i.e. public transportation, carpool, vanpool, bicycle, walking).
